Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DCS Network platform, including dcsai.ai, the dashboard at dcsai.ai/app22, all subdomain products (compute.dcsai.ai, storage.dcsai.ai, sovereign.dcsai.ai, api.dcsai.ai), and any DCS-built website hosted on our infrastructure (collectively, "the Service"). The Service is operated by DCS AI Technologies L.L.C ("DCS", "we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.

Plain-English summary. You sign up and pay for the tier you want. You own the content you put in. We own the platform. You promise not to abuse it. We promise to keep it running and protect your data. Either side can end the relationship with notice. Dubai courts settle disputes.

2. The Service

DCS provides:

Some features ship in beta, dummy mode, or are gated by your Tier. Beta features are provided as-is and may change or be withdrawn without notice. Tier-specific limits are published at dcsai.ai/pricing and may be updated with 30 days' notice.

3. Account and access

You must be at least 18 years old and able to enter a binding contract under the laws of your jurisdiction to use the Service. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at security@dcsai.ai if you suspect unauthorised access.

You may add team members or grant access to collaborators subject to your Tier limits. You remain responsible for their compliance with these Terms.

4. Fees, billing, and refunds

4.1 Subscription fees

Paid Tiers are billed monthly or annually in advance via Stripe. Your subscription auto-renews at the end of each billing cycle until cancelled. Prices are listed at dcsai.ai/pricing and are exclusive of any applicable VAT or local taxes, which will be added at checkout where required.

4.2 Usage-based fees

Some features (DCS Compute GPU rentals, DCS Inference token consumption, WhatsApp conversation overages, SMS sends, voice minutes) are billed on a pay-per-use basis. Current rates are displayed in your dashboard before each purchase. You may set spending caps in account settings.

4.3 Refunds

Monthly subscriptions are non-refundable for partial months. Annual subscriptions cancelled within 14 days of initial purchase are refundable pro-rata, less any usage-based fees consumed. After 14 days, annual subscriptions are non-refundable; you continue to enjoy the Service until the end of the paid period. Usage-based charges (compute, SMS, voice) are never refundable once consumed.

4.4 Failed payments

If a payment fails, we will retry up to 3 times over 7 days. If still unsuccessful, your account may be downgraded to Free or suspended. Stored content and bookings remain intact for 60 days, after which we may delete inactive paid-tier-only assets.

4.5 Annual discount

Annual subscriptions receive a discount of approximately 17%, equivalent to two months free.

You agree not to use the Service to:

6. Your content and our content

6.1 You retain ownership of Customer Content

You own all rights to Customer Content. You grant DCS a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display, and process Customer Content solely to operate, improve, and secure the Service. This licence ends when you delete the content or terminate your account, except for backups retained as described in our Privacy Policy.

6.2 DCS retains ownership of the platform

The Service, including its software, design, branding, AI prompts, templates, vertical template designs (restaurant, salon, clinic), and underlying infrastructure, is owned by DCS AI Technologies L.L.C and protected by intellectual property law. Nothing in these Terms transfers ownership of the platform to you.

6.3 Generated sites

The AI-generated content of your DCS-built site is licensed to you for use within the Service. If you cancel and want to migrate, you may export your site as a static HTML/CSS bundle from the dashboard; the exported files are yours to host wherever you choose.

6.4 Permanence Snapshots

If you enable the Permanence feature, periodic snapshots of your site are written to the Filecoin network through trd-storage. These snapshots are immutable and content-addressed; we cannot delete them once written. You acknowledge this irreversibility before enabling the feature. The "Permanence verified by DCS · Filecoin" footer link, when injected, points to a public certificate listing your snapshots.

7. AI-generated output

AI output is probabilistic. It can be wrong, biased, or inappropriate. You must review AI-generated content before publishing it to your website or sending it to End Customers. DCS is not liable for the accuracy of AI output.

The AI features in the Service produce text, images, broadcast drafts, review replies, and other content using third-party large language models and image models. You acknowledge:

8. Messaging channels and third parties

WhatsApp, SMS, Telegram, Instagram, voice, and email delivery rely on third-party providers (Meta, Twilio, Telegram, Resend, etc.). Their terms apply to your use of those channels:

Suspension, rate-limiting, or template rejection by any of these providers is outside our control. We will support your appeals where possible but cannot guarantee outcomes.

9. Service availability

We target 99.5% monthly uptime for the core API and dashboard, excluding scheduled maintenance and force-majeure events. Status updates are posted at our status endpoint (planned: status.dcsai.ai). The Service is provided "as available" and may occasionally be interrupted for upgrades, security patches, or fixes.

We do not offer a financial SLA on the Free, Hobby, Pro, or Team Tiers. Business OS and Sovereign Tiers include written SLAs at the time of purchase.

10. Privacy

Our handling of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Where you process End Customer personal data through the Service, you are the controller and DCS is the processor; on request we will sign a Data Processing Agreement (DPA) for customers in the EU, UK, or other jurisdictions that require one.

11. Warranties and disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, our warranties are limited to the minimum permitted by law.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event will DCS or DCS AI Technologies L.L.C be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation loss of profits, revenue, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.

These limits apply regardless of the legal theory (contract, tort, statute, or otherwise) and apply to DCS, our affiliates, our processors, and our officers, directors, employees, and agents.

13. Indemnity

You agree to defend, indemnify, and hold harmless DCS and DCS AI Technologies L.L.C from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) your violation of these Terms, (b) your Customer Content or your use of the Service, (c) your violation of any law or third-party right, including the rights of any End Customer.

14. Term and termination

These Terms remain in effect for as long as you have an account or use the Service.

You can cancel any time from the dashboard. Paid subscriptions continue until the end of the current billing period, after which they terminate.

We can suspend or terminate your account if:

On termination, your access ends, but you may export Customer Content for 30 days. After 30 days we delete Customer Content other than backups and legally required retentions per our Privacy Policy.

15. Changes to the Service or these Terms

We may update the Service to add, remove, or modify features. For material changes that reduce a paid Tier's value, we will notify you with at least 30 days' notice and offer a pro-rata refund of unused subscription if you cancel before the change takes effect.

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. For material changes, we will notify you by email or in-app banner at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, you may cancel before the new Terms take effect.

16. Governing law and dispute resolution

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai, without regard to conflict-of-laws principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be addressed by good-faith negotiation between the parties for 30 days. If negotiation fails, the dispute shall be referred to and finally resolved by:
